Hi Emma, good question and thanks for the reminder to update my links! I wish there was more recent scholarship on the topic. This article from the Annual Law Review published in 2008 found that 90% of cases were still being won by employers at that time. I don't have reason to believe things have gotten better, but I wish I knew.
